Within Directive 2008/95 trade mark use remains ill defined. In Arsenal v. Reed the CJEU offered broad guidance regarding use offline whilst in Google France they created a new test to establish the same online. The recent case Flynn Pharma v. Drugsrus suggests the existence of a divergence in approach, questioning the usefulness of this test and making a re-evaluation necessary.
